By using this Web site, the client agrees to be bound by all of the terms and conditions of Canyouproofthis.com's Terms of Service. Should the client object to any such terms and conditions or any subsequent modifications thereto or become dissatisfied with the site in any way, the client's sole recourse is to discontinue use of the site.

The client acknowledges that Canyouproofthis.com reserves the right to deny access to the client to any of the services available through Canyouproofthis.com and to refuse the offer of the client to purchase any Canyouproofthis.com service.

Canyouproofthis.com may, in its sole and absolute discretion, immediately terminate service, should the client's conduct fail to conform with the terms and conditions of the Terms of Service.

This Web site is owned and operated by ATAABOC LLC and is protected by international copyright and trademark laws. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this site, including code and software. You may download material from this site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

The client retains complete ownership and copyright of the client's submitted materials, no matter what level of service Canyouproofthis.com may have performed on them.

Should any dispute arise between the client and Canyouproofthis.com, best efforts shall be made by both parties to resolve the dispute. Should the client be unsatisfied with the quality of the services provided by Canyouproofthis.com, the client is required to contact Canyouproofthis.com at orders@canyouproofthis.com, specifying the reasons for such dissatisfaction, within seven (7) days of delivery of service by Canyouproofthis.com. Upon full consideration of the client's comments, Canyouproofthis.com will either: (a) have the work redone at no extra charge to the client, or (b) issue a credit and/or refund to the client. Refunds will be given for up to the amount of the original payment only. All refunds will be made to the credit card designated on the purchase order. No refunds will be made in cash. Should Canyouproofthis.com conclude that the work already done meets industry standards, the client can for an extra fee have the document re-edited by a different editor at Canyouproofthis.com.

All personal information provided by the client to Canyouproofthis.com, including, without limitation, the client's name, mailing address, e-mail address and credit card, shall be true and correct in all respects. The client shall make payment of the purchase price for the services with a valid credit card or by money order. Subject to the specific obligations of Canyouproofthis.com set forth in the Terms of Service, Canyouproofthis.com shall have no liability arising out of the client's failure to provide Canyouproofthis.com with the client's correct e-mail address and other information regarding the client.

Canyouproofthis.com will not be responsible for, or incur any liability to, the client in respect to any unlawful or fraudulent use involving a purchase by the client or any unlawful or fraudulent use of the client's credit card by any person.

Canyouproofthis.com in no way endorses the contents of any client communications or submitted documents. Canyouproofthis.com does not assume responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third-party intellectual property rights arising therefrom, any crime facilitated thereby or any subsequent use thereof upon completion of Canyouproofthis.com's work.

Canyouproofthis.com makes no warranty that the work will meet the client's requirements, or that the service will be uninterrupted, timely, secure and/or error-free; nor does Canyouproofthis.com make any warranty as to the results that may be obtained from the use of the site or as to the accuracy or reliability of any information obtained through the site.

The client expressly agrees that use of the site is at the client's sole risk. Canyouproofthis.com expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Canyouproofthis.com makes no warranty regarding any goods or services purchased or obtained through the site or any transactions entered into through the site. No advice or information, whether oral or written, obtained by the client from Canyouproofthis.com or through the site shall create any warranty not expressly made herein.

Canyouproofthis.com shall not be liable for any direct, indirect or incidental damages resulting from the use of, or the inability to use, the site, or for cost of procurement of substitute services, including, but not limited to, damages for loss of profits, use, data or other intangible, even if Canyouproofthis.com has been advised of the possibility of such damages.

The client agrees to indemnify and hold Canyouproofthis.com, its subsidiaries, affiliates, agents, officers and employees harmless from any claim or demand, including reasonable attorneys' fees and costs, made by any third party due to or arising out of the client's use of the site, the violation of the Terms of Service by the client, or the infringement by the client of any intellectual property or other right of any person or entity.

Canyouproofthis.com shall not be liable to the client for any failure to fulfill its contractual obligations if such failure is due to any labor dispute, fire, flood, law, governmental or political action, act of God or any other cause beyond the control of Canyouproofthis.com. In the event of any such occurrence, the agreed-upon deadline for completion of the work shall be extended correspondingly.

If any provision of the Terms of Service is unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms of Service and shall not affect the validity and enforceability of any remaining provisions. Canyouproofthis.com's failure to exercise or enforce any provision of the Terms of Service shall not constitute a waiver of such provision.

The validity, interpretation, construction and performance of the Terms of Service shall be governed by the laws of the State of California. All disputes shall be handled in the courts of Los Angeles County.

Canyouproofthis.com reserves the right to discontinue operation of the site with or without notice to users and with or without cause at any time and effective immediately. Canyouproofthis.com shall not be liable to clients or any third party for discontinuation of the site.

The Terms of Service and disclaimers, as well as the site itself, may be modified, amended and/or updated by Canyouproofthis.com at any time without notice, provided that any modification, amendment and/or update to the Terms of Service only will be effective for purchases occurring after the date that such modified Terms of Service are posted on this site.

The Terms of Service, disclaimers and order confirmation as well as follow-up e-mails constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all oral and written representations, agreements and understandings between the parties with respect to the subject matter.

The client shall be prohibited from interfering with the contractual relationship between Canyouproofthis.com and its editors and agrees not to contract separately with any current and/or former editors of Canyouproofthis.com without the prior written approval of Canyouproofthis.com.

Violation of any of the material provisions herein and failure to remedy or cure such violation within thirty (30) days after written notice thereof from Canyouproofthis.com shall be deemed to be an event of default by the client.
